2.- PURPOSE AND PROOF OF ACCEPTANCE
- The present General Conditions of purchase of products are intended to regulate the relationship between ThinkingMU (hereinafter "THE COMPANY") and you (hereinafter "the CLIENT"), relating to all transactions carried out through this website.
- The on-line contracting of the products offered by THE COMPANY through this website will be subject to the provisions of these General Contracting Conditions.
- The acquisition of the products must be made through the activation of the PAY button that appears at the bottom of the page when you finish the processing of your ORDER, and express the total acceptance of each and every one of the Contract conditions as stated shown with anteriority to the acquisition of the products, always visible at the bottom of THE COMPANY's website.
- From the moment of acceptance, the user acquires the status of Client of THE COMPANY as described in these General Contract Conditions.
The languages in which the contract between THE COMPANY and the CLIENT may be cocluded are the following: Spanish, English.
4.- INFORMATION ABOUT THE PRODUCTS
The articles offered on the Website are a selection of products of articles of clothing and accessories for men and women that meet the same quality and guarantee requirements as the products offered for sale in physical stores.
THE COMPANY has full ownership in relation to the intellectual property rights over the products that appear on the present website.
Each product is accompanied by the following information:
- Article name
- Item Image
- Description of the article
- Sizes and colors * available
- Washing instructions
- Retail Price in euros.
*Thinking MU has made an effort to show the colors of the garments as close to reality as possible. However, the color of the garments that appears on the screen of your device may be subject to variations depending on the quality or type of it. In this sense, we cannot guarantee that the colors that appear on the screen of your device will faithfully adjust to reality.
In addition, the characteristics of the natural materials used in the manufacture of some of the products may present variations in texture and color. These variations will not be considered quality defects or defects.
Special offers, promotions or discounts will be valid until the indicated date or while stocks last.
5.- PURCHASE PROCEDURE
- The items to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.
- The shopping cart will contain the reference of the selected item, its name, size, chosen color and price in euros (taxes included). The price expressed does not include transport, whose rates will vary depending on the selected shipping method.
- To make the purchase, the CLIENT's personal data will be required, which will be incorporated into our database in order to process the order.
If you are a registered user, you can access, at any time, the personal data provided and the information on the orders placed.
- Before placing the order, a summary of the order will be presented to the client identifying the product (s) added in the shopping cart, its total price (transport and taxes included) with each of the items broken down and the shipping data of the order, so that the client confirms it by clicking on the button with the expression 'PAY'.
If before confirming the payment you detect an error in your order, you can modify any detail of it by clicking on the 'modify' button or add more products or delete them.
Once the order has been placed, the order number will be communicated through the Website itself so that the CLIENT can, at any time and from their device, track it.
Likewise, an automatic email message will be sent to the address indicated by the client to acknowledge receipt of the order with a description of the order, including the personal data provided by him.
Failure to receive this message may be due to some transitory communication problem on the network, or to a typing error in the email address provided, so we recommend that you contact us.
- The receipt of the referred order acknowledgment does not mean the acceptance of the order by Thinking MU. All orders are subject to acceptance by the company.
Thinking MU is not obliged to accept the order and may, at its discretion, deny its acceptance. The CLIENT, however, acknowledges that by clicking on the "PAY" button, he acquires the obligation to pay for the product (s).
In this sense, the order is considered accepted when ThinkingMU notifies the client through a new email confirming that the order has been sent.
The contract between the client and Thinking MU in relation to the requested product (s) will be understood to be concluded when the Confirmation is sent to the client.
The Contract will only deal with the products that have been credited in the Confirmation. Thinking MU will not be obliged to supply any product that has not been confirmed.
6.- AVAILABILITY OF THE PRODUCTS
All orders are subject to the availability of the products. If at the time the order is issued, Thinking MU detects the lack of stock in its warehouses of any of the products included in it, it will try to locate the product by other means that may be within its reach. If it is not possible to have such availability, the client will be notified immediately. In addition, the amount of the item collected and not sent, will be paid to the CLIENT in the following days, by the same means of payment used in the purchase.
7.- RIGHT TO NOT ACCEPT AN ORDER
Thinking MU may cancel any Confirmed order or not accept an order placed for the following reasons:
- In case of a technical error and / or a typographical error in the prices or in the rest of the data of the products contained in the Website when the order was placed.
- Due to lack of availability.
- When the security systems indicate that the order may be fraudulent.
- When we have not been able to deliver the order to the address provided by the CLIENT.
- When there is a computer attack, virus or any event due to force majeure.
In such cases, Thinking MU will fully reimburse the amounts that have been paid.
8.- PRICES AND FORM OF PAYMENT
The prices indicated on this website are shown in EUROS and include VAT at the rate in force at all times.
However, in accordance with the provisions of Law 37/1992, of December 28, regulating said tax, the operation may be exempt or not subject to it depending on the country of residence of the buyer and the condition in which it acts, (employer / professional or individual). Consequently, in some cases the final price of the order may be altered with respect to the one displayed on the website.
In shipments made to countries outside the European Union, THE COMPANY will not assume the expenses corresponding to taxes and customs duties of each country.
The offers will be duly marked and identified as such, conveniently indicating the previous price and the price of the offer.
THE COMPANY reserves the right to make on the Website, at any time and without prior notice, the modifications it deems appropriate, being able to update products and services according to the market.

9.- SHIPPING POLICY
Deliveries are sent to the delivery address indicated by the CLIENT, within the terms indicated in the attached table. In case of not having stock, THE COMPANY will duly notify the CLIENT of this matter as soon as possible.
The COMPANY sends orders to its CLIENTs through different express transport companies of recognized national and international prestige.
The delivery date to the CLIENT's address depends on the availability of the chosen product and the shipping area. Before confirming your order, you will be informed about the approximate transport times.
However, these deadlines can be altered by extraordinary incidents in the carrier and by difficulties in the delivery of the merchandise.
In any case, if the CLIENT does not receive the order within the maximum legal period of 30 days from the hiring, he can contact us.

10.- EXCHANGE AND RETURN POLICY
To proceed with the return or exchange of an item purchased in the online store, you must:
- Request the return or change of size by mail to firstname.lastname@example.org within a period not exceeding 15 business days following the date of receipt of the product, letting us know the reason for the return if you think it is necessary to help us to continue improving or, where appropriate, the new size.
- Items must be returned:

- Until we receive the item in our warehouse, it is your responsibility.
- We recommend that you send us the item by courier or certified mail and that you keep the proof of shipment.
- We will refund you (always within a maximum period of 14 days from receipt of your request) or we will resend you the new size when the garment arrives.

Thinking MU cannot accept exchanges or returns of used or damaged garments (as long as it is not a defect and / or quality or manufacturing defect). For hygiene reasons, sealed products, such as underwear and bathroom items that do not retain the label or protection device, cannot be returned.
The change of a model for a different one will not be accepted, so only the size can be changed. To exchange a product for a different one, the CLIENT must proceed to return it and make a new purchase.
Returns of erroneous or defective productsIn the event that Thinking MU has mistakenly sent a different product to the one requested, that the quality of the product sent is not adequate or that the product does not conform to what is stipulated in the contract, the amount of the returned product will be fully refunded including shipping costs.Frequent questions:
- do I have to pay anything for my return?
To return an item purchased in Thinking Mu you just have to contact a courier company or post and send the item to the address detailed above. Shipping costs must be paid by the CLIENT who wishes to make the return. In the event that the item sent was defective, thinking mu would assume the total cost of the shipment for its exchange and / or return.
- How will I receive my refund?
Once the return is approved, you will receive the amount in the same way in which you made the payment.
- When will I receive my refund?
When we verify that the items are in perfect condition and with the labels, you will receive a confirmation email indicating that the amount will be credited to your account, and always within a maximum period of 14 calendar days.
- What if the amount of the refund made was incorrect?

In the event that Thinking MU has mistakenly sent an item other than the one requested or that the quality of the item sent is not adequate, please contact us at firstname.lastname@example.org for the return and / or exchange. in this case, thinking mu will assume the costs of both the shipping and the return.
In the case of special promotions, where the shipping costs are offered free, the CLIENT must also bear the transport costs of the return.

The COMPANY guarantees the CLIENT the possibility of canceling the order at any time and at no cost as long as the cancellation is communicated before the order has been made available to the carrier for shipment. Otherwise, you must wait to receive the order to exercise the right of withdrawal.

In case of withdrawal on your part, we will refund all payments received, including delivery costs and, in any case, within a maximum period of 14 calendar days from the date of notification. We will proceed to make said refund, using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise.
In the event that THE CLIENT has expressly selected a mode of delivery different from the less expensive mode of ordinary delivery, THE COMPANY will not reimburse the additional costs derived from it.
The returned order must be delivered together with the delivery note and, where appropriate, the invoice issued by THE COMPANY, with the CLIENT paying the return costs. THE CLIENT may return any item purchased from THE COMPANY as long as the products retain their original seal or packaging and the manuals, accessories or promotional gifts included where appropriate. The CLIENT will only be responsible for the decrease in value of the goods resulting from a manipulation of the same other than that necessary to establish their nature, their characteristics or their operation.
If a product other than that requested by the CLIENT was delivered by mistake by THE COMPANY, the correct product will be delivered, collecting the first one, without any additional charge for THE CLIENT.
If a product has arrived at the CLIENT broken, damaged or in poor condition, THE COMPANY will take care of picking it up at their home, replacing it with another in good condition, without additional charges.
12.- LEGAL GUARANTEE AND RESPONSIBILITIES OF THE COMPANY
Products are covered by a two-year legal guarantee against non-conformity under the provisions of the General Law for the Defense of Consumers and Users (RDL 1/2007, of November 16). By said Law, the consumer has the right to claim against the seller and, in certain cases, against the manufacturer for any lack of conformity that exists at the time of delivery of the good within the terms and conditions established therein.
If the lack of conformity of the product manifests itself during the first six months, it is understood that the failure already existed when the product was delivered, unless otherwise proven or when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.
If the lack of conformity appears after those first six months, it will be up to the CLIENT to prove that the defect is original so that it is covered by the legal guarantee.
The CLIENT has the obligation to report possible defects and non-conformity within 2 (two) months of their detection.
In the event of a defect in conformity, we will proceed, at our expense, to reestablish the conformity of the product by repairing / replacing or reducing the price, as established by current legal provisions.
Warranty assistance requires the prior presentation of the purchase invoice.

13.- RESPONSIBILITIES OF THE CLIENT
The CLIENT undertakes to make lawful use of the services, without contravening current legislation, or harming the rights and interests of third parties.
The CLIENT guarantees the veracity and accuracy of the data provided when filling in the contracting forms, avoiding causing damages to THE COMPANY as a result of their incorrectness.
Failure to comply with any of the Contract Conditions may lead to the non-acceptance of an order and consequently to the non-delivery of a product.
